Learned counsel for the petitioner submits that now the Appellate Authority is functional and in that view of the matter he seeks permission to withdraw the writ petition in order to approach the State Appellate Authority.
Permission is granted.
In case, the petitioner files appeal before the State Appellate Authority within a period of one month from today, the Appellate Authority will examine and decide the appeal of the petitioner in accordance with law on its own merit after
Patna High Court CWJC No.17920 of 2016(2) dt.02-02-2018 2/2 condoning the delay, if any, in filing of the appeal in view of the fact that the petitioner was pursuing remedy by way of filing writ petition.
With the aforesaid liberty, the writ application is dismissed as withdrawn.
