The petitioner seeks regular bail in connection with East Colony P.S. Case No. 45 of 2016, registered for offences punishable under Sections 457 and 380 of the Indian Penal Code. Allegation against the petitioner is of committing theft in the rented house of the informant.

It has been submitted on behalf of the petitioner that initially the F.I.R was lodged against unknown, however, later on petitioner's name has been dragged in this case only on the basis of suspicion and though it is alleged that one mobile, cash Rs. 5000 to 6000 and a golden Jhumka worth Rs. 20,000 has been stolen, however, nothing has been recovered from the possession

Further it is also alleged that one mobile has been recovered from the possession of the petitioner but the same belongs to petitioner and does not match with the description of the stolen mobile. Petitioner has no criminal antecedent and has been in judicial custody since 26.03.2017.

Learned counsel for the State opposed the prayer for bail. Considering the fact that petitioner's name transpired on this case only on the basis of suspicion and except that there is nothing against the petitioner and he has clean antecedent and has remained in custody for more than two months, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IV, Munger, in connection with East Colony P.S. Case No. 45 of 2016. (S. Kumar, J) sunil/- U T
