Allegation against the petitioner is about recovery of 30 ltrs. of liquor from the possession of the petitioner. Submission of the learned counsel for the petitioner is that earlier the petitioner had prayed for regular bail, which has been disposed of vide order dated 12.12.2018 passed in Cr. Misc. No.71654/18 with a direction to the court below to verify the criminal antecedent. However, as petitioner has criminal antecedent, he has not been granted bail. Further submission is that he is in custody for about nine months but no substantive progress has been made in the trial.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above
Patna High Court CR. MISC. No.12686 of 2019(3) dt.26-06-2019 2/2 named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Special Case No.9090 of 2018 arising out of Khajekalan P.S.Case No.351 of 2018, with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled. With the aforesaid direction, this application is allowed.
