The Petitioners seek bail in Patahi P.S. Case No. 36 of 2017 instituted for the offence under Section(s) 272, 273, 290 of the Indian Penal Code and Section 30 of the Bihar Excise Amendment Act.

It is alleged that 105 litres and 70 litres respectively of mixed toddy were recovered from the possession of these petitioners.

It has been submitted on behalf of the petitioners that petitioners are in custody since 11.03.2017. It has been mentioned in para 3 of the petition

Patna High Court Cr.Misc. No.19830 of 2017 (2) dt.04-05-2017 2/2 that petitioners have no criminal antecedent. From the written report itself, it does not appear that there is any specific allegation against these petitioners that they are indulged in sell and purchase of illicit liquor. In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the Petitioners, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of 8th Additional Chief Judicial Magistrate, East Champaran in connection with Patahi P.S. Case No. 36 of 2017, subject to the conditions that both the bailors shall be the close relative of the petitioners.
