Petitioners, already in custody, seek bail in connection with Jokihat P.S. Case No.23 of 2018, registered under Sections 379/34 of the Indian Penal Code.
It transpired during investigation that leading to confessional statement of the petitioners, the pump set as well as battery both were recovered from each one of them. Learned counsel for the petitioners submits that the specific allegation in the FIR is that pump set of Honda company was stolen whereas the seizure list clearly indicates that the pump set is of Birla Power company and battery is a common article and there was no specification in the FIR,
Patna High Court Cr.Misc. No.21412 of 2018(2) dt.13-04-2018 2/2 moreover both petitioners have clean antecedent. Having considered the aforesaid facts and circumstances, petitioners, namely, Abul Hassan @ Abu Hassan and Mushabbir @ Masbir are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Jokihat P.S. Case No.23 of 2018.
