Petitioners seek bail in Paharapur P.S. Case No. 99 of 2016 for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 326, 379, 307, 504 and 506 of the Indian Penal Code.
It has been submitted on behalf of the petitioners that the petitioners have been falsely implicated in this case due to village politics and this case is counter blast. It is further submitted that some of the co-accused persons have been granted bail by a co-ordinate bench of this court vide order dated 06.12.2016, passed in Criminal Miscellaneous No. 41282 of 2016.
Patna High Court Cr.Misc. No.22779 of 2017 (2) dt.22-05-2017 2/2 Learned APP for the State opposes the prayer for bail.
Considering the above facts and circumstances, this petition for bail is allowed and the petitioners named above, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran in connection with Paharpur P.S. Case No. 99 of 2016.
