JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 09-06-2015 The petitioner apprehends his arrest in relation to Dumra P.S. Case No. 27 of 2009 (G.R. No. 206 of 2009) registered under Sections 419, 420, 467, 468, 471 and 120B of the Indian Penal Code and Section 7 of the Essential Commodities Act.

In view of the fact that the petitioner was the driver of the tanker who managed to escape when the tanker was seized allegedly carrying kerosene oil illegally and that he has now after five years moved for anticipatory bail, I am not inclined to entertain this application. It is, accordingly, dismissed. However, petitioner is directed to surrender before the court below within four weeks and seek regular bail where his prayer may be considered on its own merit without being prejudiced by the order of this Court.
