2. The petitioner seeks regular bail in connection with Bathnaha P.S. Case No.217 of 2024 lodged under Sections 341, 323, 324, 326, 307, 506/34 of the IPC.

3. As per the prosecution case, the FIR has been lodged against two named accused persons including the petitioner with allegation that the petitioner has abused and assaulted to the informant's uncle by which injury has been caused to him. Subsequently, when informant reached there to save his uncle, then the petitioner has attached on the informant also by lathi and weapon due to which they were injured and referred to hospital.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that from the contents of FIR, it becomes crystal clear that land

Patna High Court CR. MISC. No.13388 of 2025(2) dt.11-04-2025 2/2 dispute is going between the parties and there was no intention to kill the informant and his uncle and there is general and omnibus allegation against him.

5. Counsel further submits that petitioner is in custody since 10.12.2024 and his antecedent is clean. He further submits that one of the co-accused person has been granted anticipatory bail by this Court vide order dated 12.11.2024 passed in Cr. Misc. No.75940 of 2024.

6. Learned counsel for the State opposes the prayer for bail and submits that there is direct allegation against the petitioner and from the contents of FIR, it transpires that there is land dispute between the parties and both parties are well known to each other.

7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Sitamarhi, in connection with Bathnaha P.S. Case No.217 of 2024 , subject to the following conditions as laid down under Section 437(3) of Cr.P.C.
