JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-06-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in Dawath Police Station Case No. 117 of 2020 registered for the offence punishable under sections sections 25(1-B)(a), 26 and 35 of the Arms Act. As per the prosecution case, in course of investigation in Dawath Police Station Case No. 116 of 2020, police raided a house and apprehended (1) Sonu @ Sonu Chaudhary @ Sunny Chaudhary @ Sunny Kumar Chaudhary and (2) Abhay Choudhary @ Abha Choudhary and on search, a country made pistol was recovered from said co-accused Sonu @ Sonu Chaudhary @ Sunny Chaudhary @ Sunny Kumar Chaudhary, who is petitioner in this case, and registered the instant case, namely, Dawath Police Station Case No. 117 of 2020. However, police remanded the petitioner only in Dawath PS Case No.116/2020.
It is submitted on behalf of the petitioner that in the instant case, a country made pistol is said to have been recovered from the possession of the petitioner. Learned counsel for the State opposes the prayer for
Patna High Court CR. MISC. No.13787 of 2023(3) dt.26-06-2023 2/2 bail. He submits that the petitioner has got criminal antecedent of similar nature.
Considering the aforesaid facts, prayer for bail of the petitioner is rejected.
