Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Section 30(a), 30(b) and 30(c) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and allegation is of recovery of 15 litres of liquor along with 330 litres of semiprepared liquor from different houses, and 30 litres of semiprepared liquor from house of petitioner. 4.
Learned counsel for the petitioner submits that the petitioner was not arrested from the spot as such nothing was recovered from his conscious possession, though there is allegation that 30 litres of liquor was recovered from his house. It is also submitted that after the amendment in the Excise Act in
Patna High Court CR. MISC. No.15557 of 2024(2) dt.12-03-2024 2/2 the year 2018, the concept of deemed possession and presumed offender has been done away with.
