The petitioner apprehends his arrest in Dumariya P.S. Case No. 12 of 2014, registered for the offences punishable under Section 304B and other Sections of the Indian Penal Code. The father of the deceased alleged that all the accused persons killed his daughter Kavita Devi @ Pago Devi. It is submitted that the petitioner is brother-in-law of the deceased. Akhilesh Yadav is the husband of the deceased. The petitioner is living separately and he has no manner of concern with the family affairs of the deceased and her husband. The informant has also not made any specific allegation against the petitioner.
Taking into consideration that no specific allegation is

No.6482 of 2015 (2) dt.18-02-2015 2/2 made against the petitioner and the petitioner is brother-in-law of the deceased, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Sherghati, Gaya in connection with Dumariya P.S. Case No. 12 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
