JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date : 01-03-2019 The appellant seeks pre-arrest bail in connection with Gogri P.S. Case No. 320 of 2018, registered for offences punishable under Sections 498(A) of the Indian Penal Code, Section 3⁄4 of the Dowry Prohibition Act and Section 3(i)(r)(s) of SC/ST Act.

Allegation against the appellant is of subjecting his wife to cruelty and harassment with respect to demand and also abusing her by taking caste name.

Submission of learned counsel for the appellant is that the whole case is false and concocted and earlier he was granted privilege of police bail under Section 41(A) Cr.P.C. and did not misuse the same.

APP (SJ) No.711 of 2019 dt.01-03-2019 2/2 Having heard both sides, in view of the facts and circumstances of the case, this appeal is disposed of with a direction to the appellant to surrender before the learned Special Judge and make prayer for regular bail, which will be considered by the learned Special Judge on the basis of materials available on record and also consider the fact that the appellant was on police bail and not misused the same. Accordingly, this appeal is disposed of.
