The petitioner seeks bail in Riga P.S. Case No.334 of 2019, registered under Section 30(A) of the Bihar Prohibition and Excise Act.

The informant alleged that he got secret information that some persons were selling liquor in the orchard of Ram Chandra Sahni and on such a raid was conducted. The petitioner, namely, Rambahadur Sahni was arrested on the spot and other accused persons managed to flee away. Learned counsel for the petitioner submits that the petitioner was not selling any liquor. The petitioner had gone in the orchard but on mere presumption that the petitioner was also one of the persons who were selling liquor from the orchard of Ram chandra Sahni the petitioner has been arrested and he is in

Patna High Court CR. MISC. No.10811 of 2020(2) dt.29-02-2020 2/2 custody since 07.12.2019.

Taking into consideration the facts aforesaid and the fact that the petitioner has already remained in jail for about three months, petitioner, namely, Rambahadur Sahni is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Riga P.S. Case No.334 of 2019.
