JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 22-05-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Bihra P.S. Case No. 73 of 2016 registered under Sections 147, 148, 149, 341, 323, 324, 307 and 504 of the Indian Penal Code.

As per the prosecution case, the petitioner and another accused have assaulted on the head and arm of the brother of the informant by means of farsa causing grievous injury on the hand and simple injury on the head.

It is submitted by learned counsel for the petitioner that the allegation levelled against the petitioner is not specific rather it is general and omnibus in nature. Though the injury on hand is grievous in nature, but it is not ascertained that who has inflicted the aforesaid injury. The petitioner is languishing in

Patna High Court Cr.Misc. No.24251 of 2017 (2) dt.22-05-2017 2/2 custody since 15.03.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Bihra P.S. Case No. 73 of 2016.
