The petitioner is seeking regular bail in connection with Piprakothi P.S. Case No. 330 of 2020 instituted for the offences under Section 304B and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the informant and the family members of the petitioner, including the petitioner, have compromised the case as the informant later realised that out of anger, the present case came to be instituted without verifying the correct facts. The learned counsel further submits that since good sense prevailed between the parties on account of intervention of well-wishers as such a compromise petition dated 12.10.2020 signed by both the parties have been submitted in the learned court below and the same is marked as

Patna High Court CR. MISC. No.23267 of 2021(3) dt.17-11-2021 2/2 Annexure 2 to the present bail application.

Learned A.P.P. submits that since the parties have compromised as such for the present, the same fact can be verified from the learned court below for the purposes of bail. Considering the fact that the parties have compromised the case and a compromise petition as aforesaid has been filed in the court below, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Piprakothi P.S. Case No. 330 of 2020 subject to the condition as laid down under Section 437 (3) Cr.P.C. only after the learned court below after calling the informant is satisfied that the parties have compromised the case without any coercion or force.
