====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------ 18-04-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Saharghat P.S. Case No.66 of 2015 registered under Sections 302 and 201/34 of the Indian Penal Code.

The prosecution case is that the marriage of Navina Devi, the daughter of the informant Hari Safi, was performed with the co-accused Shrawan Safi, one of the son of the petitioners, about ten years back and due to their wedlock, there are three children. The co-accused, Shrawan Safi had illicit relation with his aunt and due to that reason, Navina Devi, tried to convince her husband Shrawan Safi, on which, she was assaulted by her husband Shrawan Safi. After one day, on

Patna High Court Cr.Misc. No.9760 of 2016 (2) dt.18-04-2016 2/2 25.09.2015, the informant received information through mobile phone from Navina Devi that she had been assaulted by her husband and inlaws. On this information, when the informant reached at the Sasural house of his daughter then he came to know that his daughter had been killed and her dead body has been disposed of. Learned counsel appearing on behalf of the petitioners submits that, admittedly, Navina Devi, the daughter of the informant, who was wife of the co-accused Shrawan Safi, one of the son of the petitioners, used to reside separate from the petitioners and the petitioners have falsely been implicated in this case.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Benipatti, Madhubani, in connection with Saharghat P.S. Case No.66 of 2015, subject to the conditions laid down under Section 438(2) Cr. P.C.
