Heard learned counsels for the petitioner and the State.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 451 and 254/34 of the Indian Penal Code. It is alleged that the petitioner and one Moni Kumar entered into the house of the informant when the informant made complaint to the father of petitioner then she was abused and assaulted. It is submitted by learned counsel for the petitioner that for petty dispute, accusation has been levelled.
There is counter version of occurrence. A statement has been made in paragraph
Patna High Court Cr.Misc. No.12678 of 2015 (2) dt.26-03-2015 2 / 2 no. 3 of the petition that the petitioner has no criminal antecedent and Moni Kumar has been granted anticipatory bail by this Court vide Cr. Misc. NO. 7332 of 2015.
Considering the aforesaid facts, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Dhanarua P.S. Case No. 101 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Masaurhi, Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
