Petitioner is languishing in judicial custody since 20.12.2016 in connection with Muffasil P.S. Case No. 423/2016 for offences alleged under Sections 323, 504/34 and other allied Sections of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.
The prosecution case is that the petitioner married with the informant through affidavit before the Public Notary and also taken her to Bombay and accepted her as wife as per Muslim Law. After some time, he refused to keep her and took her mother's money and has also abused and assaulted her. It has been submitted by the learned counsel for the petitioner that he is innocent and has been falsely implicated in
Patna High Court Cr.Misc. No.22880 of 2017 (3) dt.23-06-2017 2/2 the aforesaid case and such allegation have been levelled against the petitioner only to put pressure for marriage. It has further been submitted that charge-sheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence. However, learned APP for the State opposes the prayer for bail.
Considering the facts aforesaid and materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Mufassil P.S. Case No. 423/2016.
