1. Heard learned counsel for the petitioner and learned A.P.P. for the State Mr. Chandra Bhushan Prasad.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 279, 336 of the IPC and Sections 30(a) and 41 of Bihar Prohibition and Excise Act, 2022 and 139 of Indian Electricity Act.

3. Learned counsel for the petitioner submits that petitioner has antecedent of 7 cases out of which two cases are under the Excise Act and is in custody since 02.06.2025. It is next submitted that petitioner had earlier moved before this Court seeking regular bail by filing Cr. Misc. No.5052 of 2026 and the same was permitted to be withdrawn by an order dated 30.01.2026 with liberty to renew his prayer for bail after

Patna High Court CR. MISC. No.17663 of 2026(2) dt.18-04-2026 2/3 framing of charge. Learned counsel submits that charges have been framed against the petitioner by an order dated 03.09.2025. It is submitted that when Cr. Misc. No.5052/2026 was taken up, on the said date, inadvertently it could not be submitted that charges against the petitioner stands framed.

Learned A.P.P. opposes the prayer for bail of the petitioner and submits that petitioner has antecedent of seven cases and if petitioner is granted the privilege of regular bail, the petitioner may abscond, on which, the learned counsel appearing on behalf of the petitioner submits that petitioner will not abscond rather will cooperate in the trial to prove his innocence.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Saur Bazar P.S. Case No.354/2024.

6. Further, one of the bailors of the petitioner shall be his father, namely, Vijendra Yadav @ Vijendra Kumar Yadav.

7. It is made clear that if the learned trial court comes

Patna High Court CR. MISC. No.17663 of 2026(2) dt.18-04-2026 3/3 to a conclusion that petitioner after his release is trying to delay the trial in any manner, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.

8. Further, the petitioner will keep marking his attendance in the concerned P.S. in between 27th to 30th of every month commencing from April, 2026 till the trial is not completed.

9. It is also made clear that if it is brought to the notice of the learned trial court by the concerned P.S. that petitioner has not marked his attendance in the P.S. in between the aforesaid dates in any of the month before completion of the trial, in that event, also the learned trial court shall be at liberty to cancel the bail bonds of the petitioner after recording reason.

10. Let a copy of this order be sent to the concerned P.S. by the learned trial court.
