The petitioner seeks bail in connection with Sugauli P.S. Case No. 172 of 2016, registered under Sections 304-B and 201/34 of the Indian Penal Code.
The accusation is of killing of the daughter of the informant by her husband and other in-laws due to nonfulfillment of demand of dowry and also disposing of her dead body.
Learned counsel for the petitioner submits that petitioner is the father-in-law of the deceased and he has falsely been implicated in this case. Further submission is that, in fact, deceased, daughter of the informant, died due to diarrhea and in
Patna High Court Cr.Misc. No.23888 of 2017 (3) dt.28-06-2017 2/2 presence of the informant her last rites was performed, but due to ulterior motive the present case been lodged. Further submission is that husband of the deceased is in custody. The petitioner is in custody since 03.03.2017.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran in connection with Sugauli P.S. Case No. 172 of 2016.
