Petitioner, already in custody, seeks bail in connection with Gandhi Maidan P.S. Case No.566 of 2017 registered under Section 379 of the Indian Penal Code.

It is submitted that the stolen motorcycle was in possession of Nitish Kumar and he was driving the motorcycle, the petitioner had taken lift and he was pillion rider as mentioned in the FIR itself moreover the petitioner has no criminal antecedent.

Having considered the aforesaid facts and circumstances, petitioner Phulchandra Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the
