Petitioner seeks bail in Ladaniya P.S. Case No.11 of 2020 registered under Sections 272, 273, 414 and 34 of the IPC and under Section 30(a) of the Bihar Prohibition and Excise Act. The police intercepted two motorcycles and one Santro Car in which the petitioner were sitting. One of the motorcyclists fled away taking advantage of darkness. Altogether 180 litres of Nepali liquor was recovered from the Santro Car and the bags being carried on the motorcycles. Learned counsel for the petitioner submits that the petitioner has no manner of concern with the motorcycles or the Santro Car. The petitioner was not even sitting in the Santro Car but he was apprehended while the petitioner was moving on the

Having considered the facts that some persons were apprehended including the petitioner while carrying 180 litres of Nepali liquor but the petitioner remained in jail for one and half months and he has got no criminal antecedent as stated in para 3 of the bail petition, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned Additional District & Sessions Judge IIcum-Special Judge, Excise Act, Madhubani in connection with Ladaniya P.S. Case No.11 of 2020 corresponding to G.R. No.125 of 2020.
