JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-04-2018 The petitioner is apprehending his arrest in connection with Jandaha P.S. Case No. 159 of 2016, registered for offences punishable under Sections 147, 148, 149, 307, 387, of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner and others is of indiscriminately firing causing injuries to four persons. It has been submitted on behalf of the petitioner that false and concocted case has been lodged, which will appear from the fact that husband of the informant has not got himself treated in sadar hospital and he confined himself to some other place and further there is no specific allegation of firing against the petitioner.
Patna High Court Cr.Misc. No.8089 of 2018 (3) dt.09-04-2018 2/2 Learned counsel for the State opposed the prayer for bail stating that in this case four persons have received injuries. Having heard both sides, considering the facts and circumstances of the case and nature of allegation, I am not inclined to release the petitioner on bail, this application is accordingly dismissed.
However, the petitioner, so desire may surrender before the court below and pray for regular bail and if any such application is filed the court below shall dispose of the same on the merit of the case.
