2. These two bail applications arise out of same P.S. case being Banmankhi P.S. Case no.413 of 2024 registered for the offence under sections 8(c), 21(b) and 25 of the N.D.P.S Act
Patna High Court CR. MISC. No.14228 of 2025(2) dt.19-03-2025 2/3 leading to Special (NDPS) Case No. 07 of 2025.
3. The allegation in the F.I.R is that the police officials upon receiving a confidential information proceeded for recovery and found two persons on the motorcycle who started to flee away on seeing the police official. Two persons who were apprehended were Md. Azim and Md. Soyab, the petitioners herein, in Cr. Misc. No. 14228 of 2025 and Cr. Misc. No. 14572 of 2025 respectively. After the search having been conducted, a recovery of 5.51 grams of smack was made from both the petitioners making it to a total of 11.02 grams.

It is submitted by learned counsel for the petitioners that small quantity of smack being 5 grams, both the petitioners have been found to be in possession of narcotic, just a little over the small quantity. Both the petitioners have no criminal antecedent and they are in custody since 11.11.2024.
5. The application for bail is opposed by learned APP for the State.
6. Considering the fact that both the petitioners have no criminal antecedent and they are languishing in custody since 11.11.2024, they are directed to be enlarged on bail in connection with Banmankhi P.S. Case no.413 of 2024 on each of them furnishing bail bond of Rs.20,000/- (Rupees Twenty

No.14228 of 2025(2) dt.19-03-2025 3/3 Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District and Sessions Judge, Purnea subject to the following conditions:- (I) One of the bailors shall be own/close member of the family of the petitioners.
(II) The petitioners shall cooperate in the investigation and shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioners.
