The petitioner seeks bail in connection with G.O. Case No. 76 of 2013 registered for the offence punishable under Section 47(a) of the Bihar Excise Act 2016.

Learned counsel for the petitioner submits that the driver of the vehicle from which the illicit liquor has been recovered, has already been allowed bail vide order dated 14.02.2014 passed in Cr. Misc. No. 1598 of 2014. Further submission is that the petitioner was behind the Pickup Van from which the recovery was made, on motorcycle. The petitioner is in custody since 29.03.2017.

Considering the facts and circumstances of the case,

Patna High Court Cr.Misc. No.24340 of 2017 (3) dt.31-05-2017 2/2 prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with G.O. Case No. 76 of 2013.
