The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 467, 468 and 420 of the Indian Penal Code.
The prosecution case is that the Circle Officer, Punpun lodged the present case on 26.12.2015 alleging therein that Jamabandi No. 19 of Mouza - Lakhana Thana No. 65 appertaining to Plot No. 205 an area of 0.36 decimals was recorded in the name of Pyari Devi wife of Ram Dayal Lal but wrong Jamabandi was created with respect to 0.26 decimals in favour of Savitri Devi and rent receipt was issued in 2001-02 by
Patna High Court Cr.Misc. No.10498 of 2016 (2) dt.10-03-2016 2/2 the petitioner being Revenue Karamchari.
It is submitted by learned counsel for the petitioner that on application of Savitri Devi wife of late Suresh Mahto Mutation Case No. 238of 2001-02 was started when the mutation order was passed by the then Circle Officer in favour of Savitri Devi, consequently Jamabandi was created and the rent receipt was issued.
Considering the fact that Jamabandi was created in pursuance of the order passed by the then Circle Officer, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna in connection with Punpun P.S. Case No. 300 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
