The petitioner seeks regular bail in connection with Session Trial No. 374 of 2019/60 of 2019 arising out of Kasma P.S. Case No. 40 of 2019 registered for the offence under Sections 304(B)/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the petitioner happens to be husband of the deceased and altogether six persons have been implicated in this case but there is no specific allegation attributed to the petitioner. The petitioner is languishing in judicial custody since 24.06.2019.
Learned A.P.P. for the State has opposed the prayer for
Patna High Court CR. MISC. No.11001 of 2020(3) dt.05-06-2020 2/2 bail and submitted that the petitioner happens to be husband of the deceased and he along with other family members committed murder of her wife due to non- fulfillment of dowry demand. Moreover, police have submitted charge-sheet against the petitioner under Section 304(B) of the I.P.C. Considering the facts and circumstances of the case, this Court is not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of this petitioner is rejected.
