JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Raj Nagar P.S. Case No. 197 of 2017 registered for the offences punishable under Sections 420, 379 and 506/34 of the Indian Penal Code.

As per prosecution case, the informant had gone to withdraw cash from the ATM and behind him petitioners were standing and as informant was withdrawing amount from ATM for the first time he sought help from them and petitioners transferred an amount of Rs.35,000/- to their account through ATM and later on he got message and he informed the Bank for that. Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and in spite of that they are ready to deposit the amount of Rs.35,000/- to the account of the

Patna High Court CR. MISC. No.12116 of 2019(3) dt.20-09-2019 2/2 informant.

Heard learned APP also.

In view of above facts and circumstances, let petitioners surrender in the court below within a period of two weeks from the receipt of this order along with a Bank Draft of Rs.35,000/- in favour of the informant and on verification of authenticity of the same by the court below, the petitioner shall be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Madhubani, in connection with Raj Nagar P.S. Case No. 197 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned. It is made clear that learned court below shall release the amount in favour of the informant on application being filed by him.

With the above observation, this application is disposed of.
