JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Neemchak Bathani P.S. Case No. 114 of 2017 registered for the offences punishable under Sections 341, 323, 353/34 of the Indian Penal Code and Sections 33, 41 and 42 of Indian Forest Act.

Allegation as per written report is that police intercepted one tractor loading Morang and handed over to the Chaukidar and thereafter petitioners and others came and got the tractor released from the Chaukidar.

Submission of learned counsel for the petitioner is that there is no allegation that he is owner of the tractor or Morang was loaded by him and he is ready to abide by any condition that may be imposed on him.

In view of above facts and circumstances, let petitioner surrender in the court below by 19.7.2019 and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Neemchak Bathani P.S. Case No. 114 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in the investigation and appear before police as and when required, otherwise his bail bonds shall be cancelled.
