JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-02-2020 The petitioner who is in custody since 10.12.2019 seeks bail in connection with Chariyabariyarpur P.S. Case No. 134 of 2019 instituted for the offences under Sections 188, 290, 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Approximately more than 450 cartons of liquor is said to have been recovered from four vehicles which were seized. A case was instituted against the owners of the aforesaid vehicles.

During the course of investigation, it transpired that petitioner is owner of one of the vehicles from where 146 cartons of liquor were recovered.

No.11166 of 2020(2) dt.28-02-2020 2/2 The learned counsel for the petitioner submits that petitioner had given the vehicle for being plied commercially with specific instructions that it should not be used for any illegal/unauthorized purposes. The driver of the vehicle played truant and therefore the petitioner has been made accused in this case.

Regard being had to the clean antecedent of the petitioner and his period of custody and the fact that he has not been named in the F.I.R, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousands) with sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Begusarai in connection with Chariyabariyarpur P.S. Case No. 134 of 2019.
