JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-06-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Kateya P.S. Case No. 211 of 2015, registered under Sections 147, 148, 341, 323, 324, 307, 337 and 338 of the Indian Penal Code. The accusation is that informant was returning to his field along with his brother, Kalpnath Choubey and son Amit Choubey. When they reached near the house of Shambhu Chauhan then Sambhu Chauhan, his son Ranjan Chauhan, Gharbharan Chauhan, Angur Chauhan, Sukhdeo Chauhan, Ramesh Chauhan, Sandeep Chouharn (petitioner), Munna Chouhan, Pradeep Chouhan, Pintu Choudhan, Amresh Chouhan, Satish Chouhan, Sunil Chouhan came there armed with weapons and assaulted to

Patna High Court Cr.Misc. No.23920 of 2017 (3) dt.28-06-2017 them. At that time, Sambhu Chauhan caused injury at the head of Amit Choubey, son of the informant. On raising alarm, villagers came there then accused persons started pelting stones, in which, Angoor Chouhan sustained injury at his head.

Learned counsel for the petitioner submits that while petitioner is named in the F.I.R. along with others but the specific allegation is against Sambhu Chauhan to cause injury at the head of Amit Chouhan, son of the informant. It is further submitted that petitioner has no criminal antecedent and is in custody since 25.03.2017.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj, in connection with Kateya P.S. Case No. 211 of 2015. Out of two sureties, one surety must be the close relative of the petitioner.
