The petitioner seeks bail in Antichak P.S. Case No. 38 of 2016 registered for the offence punishable under Sections 342, 376 and 506 of the Indian Penal Code and Section 4 of the POCSO Act.

Informant is the victim who in her written statement before the police has alleged that petitioner developed physical relation with her on the promise of getting married with her. Subsequently, he refused to marry her and thereafter fled away from his residence. The victim was sent to medical examination and the medical board has assessed that she is less than 18 years but has found no physical injury on any part of her body or any recent sexual assault on her. Patna High Court Cr.Misc. No.13923 of 2018(3) dt.05-04-2018 2/2 antecedent and is in custody since 09.10.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J-1, Bhagalpur in connection with Antichak P.S. Case No. 38 of 2016.
