JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-06-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bhaptiyahi Police Station Case No. 124 of 2014 registered for the offences punishable under Sections 341,307,34 of the Indian Penal Code and section 27 of the Arms Act.

Petitioner is not named in the first information report but subsequently, when the statement of injured was recorded at P.M.C.H. Patna, the name of this petitioner along with four others came in light. The injured stated that one Kasinder Mangraita shot fire on him. Moreover, having more or less similar allegation coaccused Satyendra Mangardaita had already been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order

Patna High Court Cr.Misc. No.9945 of 2015 (4) dt.23-06-2015 2/2 dated 8.05.2015 passed in Cr. Misc. No. 13859 of 2015. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Supaul in Bhaptiyahi Police Station Case No. 124 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
