2. The petitioner apprehends his arrest in connection with Shahpur P.S. Case No. 643 of 2022, instituted under Sections 30(a)/41/56 of the Bihar Prohibition & Excise Act.
3. As per the prosecution case altogether 60 litres of illicit country made liquor was recovered from the motorcycle of the petitioner.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. The seized motorcycle was stolen on 27.08.2022 for which petitioner had given written complaint before the SHO, Phulwarisharif, Patna on 28.08.2022. Petitioner had no knowledge that his stolen bike was used in the offence.
Patna High Court CR. MISC. No.14654 of 2025(2) dt.28-03-2025 2/2 Petitioner has no criminal antecedent. He was neither arrested from the spot nor any liquor was recovered from his conscious possession. Petitioner undertakes to co-operate in the investigation.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Danapur, Patna in connection with Shahpur P.S. Case No. 643 of 2022, subject to the conditions laid down in Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
