The petitioner seeks bail in Araria P.S. Case No. 598/2016, registered for the offences punishable under Sections 379, 411 of the Indian Penal Code.

It is submitted that the petitioner is not named in the F.I.R. Name of the petitioner figured in the case in the confessional statement of the co-accused. The petitioner is also said to have confessed his guilt and in pursuance of aforesaid confession stolen motorcycle was recovered from the possession of the Md. Salim @ Bablu. Nothing has been recovered from the possession of the petitioner. The petitioner is in jail since 20.10.2016.

Considering the facts aforesaid and the fact that

Patna High Court Cr.Misc. No.22306 of 2017 (2) dt.17-05-2017 petitioner has already remained in jail for 07 months, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Araria P.S.
