1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 127(2), 116(1), 118(1), 109(1), 303(2), 76, 352, 351(2), 115(2) and 3(5) of the B.N.S., 2023.
3. Learned counsel for the petitioners after some arguments seeks permission to withdraw the anticipatory bail application with respect to petitioner no.2, namely, Rajesh Kumar Ranjan with liberty to the petitioner no.2 to surrender and seek regular bail.

4. Permission is accorded.
5. It is made clear that if petitioner no.2 surrenders and seeks regular bail, the learned trial court shall consider the case on its own merit without being prejudiced by the fact that petitioner no.2 before this court withdrew his anticipatory bail application.

It is next submitted that petitioners have antecedent of one case and petitioner no.3 is a woman and the informant alleges that on 22.03.2025 at 7 A.M. the accused persons came and started abusing, on protest, Rajesh assaulted Kunal by lathi causing injury on head, thereafter Rajesh, Dinesh, Sudhanshu and Soniya surrounded his minor son and assaulted him and while he fell, Rajesh assaulted by lathi causing injury near ear and on head, thereafter aforesaid accused along with Subodh and Nilam assaulted the informant by lathi causing injury and Dinesh along with Rubi assaulted his wife and Rubi snatched her chain, further injured were taken to hospital and presently his son is in hospital at Nepal in a serious condition.
7. Learned counsel submits that petitioners have been falsely implicated in the instant case by the informant on account of dispute relating to land. It is further submitted that a title suit is pending in between the parties. It is also submitted
Patna High Court CR. MISC. No.12613 of 2026(2) dt.23-03-2026 3/3 that as far as petitioners are concerned, the allegation against them is general and omnibus in nature. It is further submitted that petitioner no.3 has been implicated only with a view to coerce the male members into submission.
8. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
9. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Udakishunganj P.S.
