JUSTICE BIRENDRA KUMAR ORAL ORDER 30-03-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 506 and 120(B) of the Indian Penal Code and 27 of Arms Act.

Though the allegation against the petitioner is of firing. However, no injury was caused to anyone. The reason for occurrence is alleged that the accused persons were pressurizing for compromise in the earlier case. Learned counsel for the petitioner submits that on the alleged date of occurrence, in the earlier case, conviction was already recorded by the learned Trial Judge. Hence, there was no question of compromise. Moreover, the petitioner is a teacher he has been falsely roped in this case.

Patna High Court Cr.Misc. No.17779 of 2018 (2) dt.30-03-2018 Petitioner has got no criminal antecedent.

Learned counsel for the informant opposed the prayer for bail on the ground that the accused persons including the petitioner attempted to pressurize for withdrawal of earlier criminal case which amounts to tampering with the evidence.

Considering the nature of allegation aforesaid, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Dumraon (Naya Bhojpur O.P.) Police Station Case No.49 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
