In this case, the petitioner is seeking regular bail in connection with Raniganj P.S. Case No. 359 of 2019, registered for the offences punishable under Sections 302, 201/34 of the IPC.

There is allegation in the FIR that 14 named accused persons and 20-25 unknown persons committed the murder and cremated the dead body of the deceased.

The learned counsel for the petitioner has submitted that the entire allegation is false. This case is on better footing than that of Subodh Kumar, Hari Narayan and Kanhaiya Nonia, who have been granted bail by the coordinate Benches of this

Patna High Court CR. MISC. No.14017 of 2023(2) dt.19-05-2023 2/2 Court in Cr. Misc. Nos. 9282 of 2020 and 8105 of 2020, because they were named in the FIR whereas the petitioner is not named. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Araria in connection with Raniganj P.S. Case No. 359 of 2019, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
