2. The petitioner seeks regular bail in connection with Mohania P.S. Case No. 369/2024 registered for the offences under Sections 302 and 201/34 of the I.P.C.

3. The prosecution case in nutshell is that the daughter of the informant was married to the petitioner in the year 2021 who is alleged to have been demanding motorcycle, fridge and cooler and upon non-fulfillment of the same was torturing the daughter of the informant. It has been alleged that the informant received a telephonic information that her daughter is seriously ill upon which the informant reached the house of her daughter and found that her daughter was killed by the accused persons including the petitioner and they have also disposed of the dead

Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case as an afterthought as the deceased had died a natural death due to acute chest pain. Learned counsel further submits that the parents of the petitioner have already been granted anticipatory bail by a Co-ordinate Bench of this Court. It is lastly submitted that the petitioner has clean antecedent and is languishing in custody since 22.10.2024.

5. Learned counsel for the State has opposed the prayer for bail of the petitioner and submits that the wife of the petitioner died in mysterious circumstances.

Considering the aforesaid facts and circumstances of the case and taking into account that there is no specific allegation against the petitioner and also the fact that the parents of the petitioner have already been granted anticipatory bail by a Co-ordinate Bench of this Court, let the petitioner above-named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Mohania, District-Kaimur at Bhabua in connection with Mohania P.S. Case No. 369/2024 subject to the conditions :-

b. The petitioner shall remain physically present in Court on each date of the trial.

c. In case of absence on two consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to the cancelled by the court concerned.

d. The Court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the aforementioned order shall not be delayed for purpose of or in the name of verification.
