The petitioner seeks bail in Bakhtiyarpur P.S. Case No. 195 of 2016 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant named ten persons including the petitioner, made specific allegations that Jitendra Kumar and Shailendra Kumar assaulted him with Pharsa on his head. Learned counsel for the petitioner submits that the informant altogether received eight injuries, out of which four injuries are said to have been caused by sharp edged weapon but, all the injuries are opined to be simple in nature. Prayer for bail of the similarly situated co-accused Shailendra Kumar @ Shailendra Yadav has already been allowed vide order dated 26.04.2017

Patna High Court Cr.Misc. No.22342 of 2017 (2) dt.19-05-2017 2/2 passed in Cr. Misc. No. 13863 of 2017. The case of the petitioner stands on the same footing and the petitioner is in jail since 25.01.2017.

Considering the facts aforesaid and the facts that the petitioner has already remained in jail for about four months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in Bakhtiyarpur P.S. Case No. 195 of 2016.
