The petitioner, who is in custody since 14.09.2019, seeks bail in connection with S. Kamal P. S. Case No. 79 of 2019 dated 23.03.2019 registered for offences under Sections 147, 148, 149, 341, 307, 302 and 323 of the Indian Penal Code.

Around 17 persons have been amed in the F.I.R., who are said to have surrounded the deceased, whereupon one other co-accused person assaulted him by means of an axe leading to his death.

No.11061 of 2020(2) dt.28-02-2020 2/3 Learned counsel for the petitioner has submitted that several persons are alleged to have surrounded and caught-hold of the deceased, which does not appear to be probable. In fact, the name of the petitioner has been given in the F.I.R. because of village politics.

The author of the fatal injury is another accused person.

Similarly situated accused persons are said to have been granted bail by different Benches of this Court.

Considering the entire facts referred to above, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with S. Kamal P. S. Case No. 79 of 2019.

While saying so, this Court has also taken note
