JUSTICE ARUN KUMAR ORAL ORDER 05-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 15.2.2018, seeks bail in Barhaiya PS Case No. 169 of 2017 registered under Sections 341, 448, 354, 325, 504/34 of the IPC and Section 12 of the Pocso Act. The allegation in brief is that while the informant was alone in the house the petitioner entered into the house and tried to outrage her modesty, in the meanwhile maternal grand-mother turned up and he also tore off her blouse, when complaint was made to the petitioner's father then he also abused the informant side. Learned Counsel for the petitioner submits that the petitioner's father and the maternal grand father of the informant are own brothers and there is dispute regarding property in between both sides so false implication was made.
Having considered the said facts and circumstances, the petitioner, namely, Manish Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge lst cum Special Judge, Pocso Act, Lakhisarai in connection with Barhaiya PS Case No. 169 of 2017.
