The petitioner seeks bail in Chauradano P.S. Case No. 14 of 2017 registered for the offences punishable under Sections 323, 366-A and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner along with Pramod Yadav is alleged to have kidnapped the victim. The victim made her statement under Section 164 Cr.P.C. but she did not disclose that the petitioner ever assaulted her physically or sexually. The petitioner is in jail since 25.02.2017 but it appears from perusal of the statement of the victim that the victim, herself, stated that the petitioner and Pramod Yadav kidnapped her at the point of dagger and wanted to marry with her. Considering the facts aforesaid I am not inclined to enlarge the petitioner above named on bail at this stage. Accordingly, the same is rejected.
The petitioner may renew his prayer for bail after remaining nine months in custody.
