Petitioners seek bail in a case registered for the offences punishable under Section 302 of the Indian Penal Code.
According to FIR, the petitioner and co-accused Ranjeet Sharma allegedly gave dagger blow at the stomach of the uncle of the informant, as a result whereof, he died. The postmortem report would reveal that the Doctor has found injuries at the abdomen of the informant caused by penetrating weapon.
Petitioner is in custody since 10.07.2017 and other eye witness has supported the allegation.
Considering the aforesaid facts, I am not
Patna High Court Cr.Misc. No.6221 of 2018 (6) dt.20-03-2018 inclined to enlarge the petitioner on bail in connection with Koilwar Police Station Case No. 144 of 2017 pending in the court of learned Chief Judicial Magistrate, Bhojpur, Ara /successor court.
Hence, prayer for bail is refused.
However, the learned trial court is directed to expedite the trial and conclude the same within nine months from the date of receipt/production of a copy of this order. (Birendra Kumar, J) Nitesh/- U T
