====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 22-11-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with N.D.P.S. Case No.82 of 2019 arising out of Chatouni P. S. Case in File No. NCB/ PZU/V/23/2019 of Narcotics Control Bureau, Patna, instituted for the offences under Sections 30(b)(ii)C-20, 23 and 29 of the N.D.P.S. Act.

The petitioner is in custody since 03.12.2019 and he is a person with clean antecedents. Charge-sheet has been submitted in this case.

Altogether 15.750 kg. of Ganja is said to have recovered from the possession of this petitioner. Learned counsel for the petitioner submits that coaccused Ashok Ram from whose possession, 14.900 kg. of Ganja has been recovered, has been granted bail by a Bench of

Patna High Court CR. MISC. No.25772 of 2021(2) dt.22-11-2021 2/2 this Court vide order 12.08.2021 in Cr. Misc. No.28822 of 2021. Learned counsel for the Central Government seeks time to file counter-affidavit, but on query of the Court how the case of this petitioner is different from case of Ashok Ram, on that learned counsel for the Central Government very fairly submits that the allegation as alleged is similar and quantity of Ganja recovered only differs.

Considering the case of co-accused, who has been granted bail by a Bench of this Court and petitioner has clean antecedent, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, NDPScum-ADJ-3rd, East Champaran, Motihari in connection with N.D.P.S. Case No.82 of 2019 arising out of Chatouni P. S. Case in File No. NCB/ PZU/V/23/2019 of Narcotics Control Bureau, Patna.

The application stands allowed.
