The petitioners seek bail in connection with Hajipur Sadar P.S. Case No. 650 of 2021 instituted for the offences under Section 414 of the Indian Penal Code read with Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioners submits that the petitioners are in custody since 11.11.2021, charge-sheet has been submitted in the case and have antecedent of one case each.

Allegation is of recovery of 1270.440 litres of liquor from a pickup van.

No.13142 of 2022(2) dt.22-03-2022 2/2 Learned counsel for the petitioners submits that the petitioners were not arrested from the spot and their name transpired based on the disclosure made by local people. Learned A.P.P. for the State opposes the prayer for bail of the petitioners.

Considering the fact that the petitioners are in custody, charge-sheet has been submitted in the case and were not arrested from the spot, let the petitioners above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.1-cum-Addl. District and Sessions Judge, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 650 of 2021.
