JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 08-06-2015 The petitioners apprehend their arrest in Goraul P.S. Case No.358 of 2014 instituted under Sections-365, 366A and 120B of the Indian Penal Code on the allegations that the petitioners are involved in kidnapping the minor daughter of the informant, Kajal Kumari. Petitioner nos.1 and 2 are the parents of one Suresh Kumar. Petitioner no.3 is the son of petitioner no.2 and petitioner no.4 is the neighbour who had offered to trace the girl if he was given the remuneration.
Learned counsel for the petitioners submits that in fact the girl, Kajal Kumari has eloped with Suresh Kumar and has married at Delhi and she is living there. The parents of the girl i.e. the informant knew about it and, therefore, they waited for almost ten days for lodging the F.I.R. The delay is not explained as to
Patna High Court Cr.Misc. No.17825 of 2015 (02) dt.08-06-2015 2/2 why they have waited for ten days. These records are available in the case diary which was not produced before the learned Sessions Judge.
Be that as it may, in the event of arrest or surrender within four weeks from today, the petitioners above-named shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Goraul P.S. Case No.358 of 2014, subject to all conditions as laid down in Section-438(2) of the Criminal Procedure Code.
