1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and he has filed an application of jointness stating that informant is staying with his father who had received the notice.

4. The informant alleges that seven customers of L&T Finance Limited complained in August, 2020 that they had applied loan which was processed by Chandan Kumar an employee of the company but the amount was not credited in

No.13098 of 2022(4) dt.20-07-2023 2/3 their account accordingly an inquiry was held and in the inquiry it transpired that Chandan Kumar got the amount credited in the account of his known persons thus the accused persons including the petitioner who was the Operation Manager of the company at the relevant point of time in conspiracy embezzled Rs.1,77,200/-.

5. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that the thrust of the allegation is on Chandan Kumar who had processed the loan and then credited the same in the account of his known persons and the petitioner being the Operation Manager at the relevant point of time came to be implicated based on suspicion as no direct role has been assigned against him in the occurrence.

6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

7. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/-
