2. This appeal has been filed against the order dated 29.01.2025 passed by learned Additional District and Sessions Judge-17 cum Special Court SC/ST Act, Sasaram, Rohtas in SC/ST P.S. Case No. 35/2024 registered under Section 341, 323, 504, 506/34 of I.P.C. and Section 3 (1) (r) (s), 3 (2) (va) of SC/ST Act by which the prayer for anticipatory bail of the appellant has been rejected. The case is pending before the Additional District and Sessions Judge-17-cum-Special Court SC/ST Act, Sasaran, Rohtas.
3. As per the prosecution case, the appellant along with another co-accused person has assaulted the informant
Patna High Court CR. APP (SJ) No.780 of 2025(4) dt.12-11-2025 2/3 with fist and slaps and also abused him with caste slur word. It is further alleged that the present appellant also threaten to kill the informant. It is further alleged that coaccused person, namely Rajesh Singh has stated that the informant has theft the motorcycle of the Rakesh Singh (brother of Rajesh Singh).
4. Learned counsel for the appellant submits that appellant has falsely been implicated in this case. He further submits that the alleged occurrence took place on 04.06.2024 but the written report was given to the police on 10.06.2024 after a delay of six days without any plausible explanation. He next submits that it is alleged that the appellant has used caste slur word upon the informant but there is no mention of any specific caste name in the FIR. He next submits that there is case and counter case between the parties as the informant was accused in Akorhigola P.S. Case No.343 of 2020 which was registered for the theft of motorcycle of Rakesh Singh and the said motorcycle was recovered from the house of Respondent No.02. The appellant is own uncle of Rakesh Singh. He next submits that appellant has got one criminal antecedent as stated in
Patna High Court CR. APP (SJ) No.780 of 2025(4) dt.12-11-2025 3/3 para-3 of the anticipatory bail petition.
5. However, learned Spl.PP for the State and learned counsel for the informant opposes the prayer for anticipatory bail of the appellant.
6. Considering the aforesaid facts and circumstances of the case and submission made by learned counsel for the appellant, let the above named appellant be released on anticipatory bail in the event of his arrest or surrender before the court below within a period of six weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-17-cum-Special Court SC/ST Act, Sasaram, Rohats in connection with SC/ST P.S. Case No.35 of 2024, subject to the condition as laid down under Section 482(2) of the BNSS, 2023.
7. The appeal stands allowed.
