JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 15-02-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Manjhi P.S. Case No. 302 of 2017 registered under Sections 30, 30(a), 38 of Bihar Excise Amendment Act -2016.

2034 liters of foreign liquor is said to have been recovered from the truck, parked on the State Highway. Nine accused persons were apprehended by the police from the spot and rest eleven persons managed to escape.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. The petitioner has no concern either with the truck or with the seized liquor. In fact, the

Co-accused Satyendra Singh @ Mantu Singh has been allowed regular bail by this Court in Cri. Misc. No. 7174 of 2018. He has been languishing in custody since 28.12.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Chapra in connection with Manjhi P.S. Case No. 302 of 2017.
